The short version
- Scorby is a scoring aid, not an official record. It is not a substitute for an umpire, and we cannot promise the score is always right.
- A subscription is what starts a match. After the 14-day trial, starting a match — on your own or with others — needs one. Joining a match someone else started is always free, and so are your history and your statistics. Exporting them to a file is a paid feature.
- The trial is 14 days and needs no card. It is not a subscription and does not turn into one by itself.
- The app store handles billing — Apple on iPhone, Google on Android. Subscriptions renew automatically until you cancel, and you cancel in that store’s settings, not here.
- In a shared match, only the player who starts it needs a subscription. Everyone else joins free.
- Nothing here removes your rights as a consumer under Cypriot and EU law.
A summary, not the terms. The sections below are what actually applies.
Who we are
Scorby is developed and provided by Sofia Eirini Petaloti, a registered sole trader established in Limassol, Cyprus, VAT registration number CY08054271S (“we”, “us”, “our”). You can contact us at info@scorby.app.
What Scorby is
Scorby is an application for iPhone, Apple Watch and Android that keeps the score of a tennis, padel or badminton match, records your history and shows statistics about how you play. It implements the scoring rules of those sports as we understand them, including serving and receiving order, changes of ends and the rest intervals each sport allows.
Scorby is an aid, not an authority. It does not replace an umpire, a referee or an official scorecard, and it is not designed for use as the official record of a sanctioned competition. If a Scorby score and the players' own agreement differ, the players are right.
Scorby is not a medical device. Heart rate, calories and any figure derived from them are shown for interest and are not fit for any medical or diagnostic purpose. Serve recognition on Apple Watch is a best-effort feature that will not always be correct, and it never changes a score you did not confirm.
Accepting these terms
By downloading, installing or using Scorby you agree to these terms. If you do not agree, do not use the app. Where you create an account, you confirm your agreement at that point as well.
Our Privacy Policy explains how we handle personal data and forms part of this agreement.
Age
You must be at least 16 years old to use Scorby. By using it, you confirm that you are.
Accounts
Most of Scorby works without an account. One is needed only for shared matches, and is created through Sign in with Apple or Sign in with Google.
You are responsible for keeping access to the account you signed in with secure, and for what happens in shared matches you take part in. You may delete your account at any time from within the app; see the Privacy Policy for what that removes.
Subscriptions
What a subscription is for
A subscription is what lets you start a match. After the free trial described in section 7, starting a match — on the phone or the watch, on your own or with other players — needs an active subscription for that sport. Four things need one:
- Starting any match, including a match you score entirely on your own.
- Starting a shared match — creating the invitation, the code or the QR that other players join with.
- Taking over the scoring in a shared match you joined.
- Exporting and importing your match history as a file. This one is not included in the free trial — see below.
Export and import need a paid subscription, and the trial does not count. The other three unlock during your 14 days; this one does not. If you are in the trial, or your subscription has lapsed, the export and import rows in Settings are shown but cannot be used.
This does not affect your legal right to your data. Your matches are on your own device and in your own backup either way, and you can always ask us for a copy of anything our servers hold, free and without a subscription — see Your rights in the Privacy Policy. What a subscription buys is the convenience of moving your history between phones yourself.
What is free, with no time limit
- Joining a match another player started, and following the live score on your own device. This never needs a subscription.
- Your match history, and the statistics drawn from it. You keep everything you have recorded and can read it all, subscription or not.
In a shared match, only the player who starts it needs a subscription. Everyone who joins plays free, for as long as they like.
Matches you have already recorded stay available to you whether or not you have a subscription. We do not lock or remove your own history.
The plans
Scorby offers a single-sport subscription for tennis, for padel or for badminton, and an all-sports subscription covering the three, each available monthly or yearly. The exact name, duration and price of each plan, in your local currency, are shown in the app before you buy and on the store listing. Prices vary by country and may change; the store will tell you before a price increase takes effect and, where the law requires, will ask you to agree to it.
Who sells you the subscription
We never take your payment ourselves. The store you installed Scorby from is the seller, and which one that is depends on your phone:
| On iPhone and Apple Watch | On Android | |
|---|---|---|
| Seller | Apple | |
| Charged to | Your Apple Account | Your Google Account |
| Manage or cancel | Settings → your name → Subscriptions | Google Play → your profile → Payments and subscriptions |
| Refunds | reportaproblem.apple.com | Google Play refund request |
| Their terms | Apple Media Services Terms | Google Play Terms of Service |
Renewal
Subscriptions renew automatically at the end of each period unless you cancel first — at least 24 hours before the period ends on both stores. Your account is charged for the renewal within 24 hours of the end of the current period. Deleting the app does not cancel a subscription, on either platform; you have to cancel it in the store, using the route in the table above.
A subscription bought on one platform does not carry across to the other. If you use Scorby on both an iPhone and an Android phone and want it on both, that is two subscriptions, because neither store can sell you access on the other's device.
Changing your plan
You can move between plans from the subscription screen in the app — monthly to yearly, one sport to all sports, or one sport to a different one. When the change takes effect, and what happens to money you have already paid, is decided by the store rather than by us. We configure it; Apple and Google carry it out.
As things stand today:
| If you | On iPhone and Apple Watch | On Android |
|---|---|---|
| Move to a longer period monthly → yearly |
Straight away. You are charged for the year today and Apple refunds the unused part of the month. | Straight away. You are charged for the year today and Google carries the unused part of the month over, extending the new period. |
| Move to a shorter period yearly → monthly |
At your next renewal. Nothing is charged today and nothing changes until the year you have paid for runs out. You keep what you bought. | |
| Add the other sports one sport → all sports |
Straight away, with the store settling the difference. | |
| Swap one sport for another tennis → padel |
Straight away, and you are refunded for what is left of the sport you are leaving. | At your next renewal. You keep the sport you have until then, and the new one starts when it ends. |
The last row is a genuine difference between the two platforms, not an oversight. Each store decides how a plan change is timed and we cannot override it, so we would rather set it out than describe one behaviour and let you meet the other. The app tells you which one applies before you confirm anything, and that sentence is written for the store you are actually in.
You are never charged twice for the same period, and a change never removes access you have already paid for.
The free trial
New users get 14 days of full access, without giving any payment details. It is not a store introductory offer and not a subscription: nothing is charged, and it does not convert into a paid subscription when it ends.
The length that applies to you is the one the app shows when your trial begins, and it is fixed at that moment — we cannot shorten a trial that has already started. Fourteen days is the length today and we have no plan to change it; we say this only because the figure is set on our side rather than baked into the app, and we would rather not print a number we could quietly contradict.
What happens when it ends, stated plainly: you will no longer be able to start a match until you subscribe. You keep everything you recorded and can still read all of it, and you can still join and follow a match another player starts. Nothing is charged and nothing is deleted — starting a new match is the thing that stops.
One thing the trial does not include, so that it is not a surprise: exporting and importing your history needs a paid subscription, and the fourteen days do not unlock it. Everything else in the app is open during the trial.
The trial is one per person, and deleting and reinstalling the app is not a way to obtain a second one. To support that, we record that a trial has begun: on iPhone in your device's keychain, which survives the app being removed, and on Android through the one-way hash described in the Privacy Policy.
Anything you recorded during the trial stays yours. We do not lock or delete matches you have already played when a trial or a subscription ends.
Cancelling and refunds
The store you bought from issues refunds, not us. We have no ability to refund a store purchase — but we are happy to help you make the case, so write to us if something went wrong and we will say what we can.
- Bought on iPhone or Apple Watch: request from Apple at reportaproblem.apple.com.
- Bought on Android: request from Google Play — Google Play → your profile → Payments and subscriptions → Budget and history, or the Google Play refund page.
Cancelling and refunding are different things. Cancelling stops the next renewal and leaves you with what you have already paid for until the period ends; a refund returns money already taken. Cancelling is in section 6.
Your right of withdrawal
As a consumer in the EU or EEA you normally have 14 days to withdraw from a distance contract without giving a reason. For digital content and services supplied immediately, that right ends once supply has begun with your prior express consent and your acknowledgement that you lose the right of withdrawal — which is what you give when you confirm an in-app purchase and access the paid features straight away.
Both Apple and Google apply their own, often more generous, refund practice. Nothing in this section limits any statutory right you have that cannot be limited by contract, and nothing in it is intended to discourage you from exercising one.
Your licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to use Scorby on Apple devices you own or control, as permitted by the App Store Terms of Service, for your own non-commercial use.
Scorby, its name, its logo, its design and its code remain ours. You may not copy, modify, translate, reverse-engineer, decompile or disassemble the app, attempt to derive its source code, remove any notices from it, or rent, lease, lend, sell or sublicense it — except where that restriction is prohibited by law, or to the extent applicable law expressly permits it despite this limitation.
Acceptable use
Please do not:
- Use Scorby to harass anyone, or enter names, text or match codes intended to abuse, impersonate or offend.
- Try to reach matches, invitations or accounts that are not yours, or to circumvent the security rules that protect them.
- Interfere with the service, load it in an automated way, or attempt to disrupt shared matches other people are playing.
- Use Scorby to break the law, or in breach of the App Store terms.
Naming other people
Scorby lets you type in players who do not have the app, so that a doubles match can be scored properly whoever turned up. When you enter someone else's name, you are responsible for doing so appropriately: use a name that person would be comfortable with, prefer a first name, and remove it if they ask you to. In a shared match, the names you type are visible to the other players.
Your data
Your matches are yours. They live on your device and in your own backup — your iCloud on iPhone, your Google account's backup on Android — and Scorby can export the lot to a file, which is a paid feature described in section 6. We do not claim ownership of your match history, and we do not use it to train anything or sell it to anyone. Whatever your subscription status, you can ask us for a copy of anything our servers hold and we will send it, free.
You are responsible for keeping your own backups. Deleting the app, signing out of iCloud or your Google account, turning the backup off, or losing a device can lose data that we have no copy of and cannot restore.
Accuracy and availability
We work hard to get the scoring rules right and we test them thoroughly, but we cannot promise that Scorby is free of errors, that a score is always correct, that serve detection works in every case, or that the app or its shared-match service will always be available or uninterrupted. Shared matches depend on a network connection and on services we do not operate.
To the extent permitted by law, and beyond what the following paragraph preserves, Scorby is provided “as is” and “as available”, without warranties of any kind.
Your statutory rights are unaffected. As a consumer you have rights under Cypriot and EU law — including that digital content and services must be as described and fit for purpose — and nothing in these terms excludes or limits them.
Liability
We do not exclude or limit our liability where the law does not allow it. In particular, nothing in these terms limits liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited.
Subject to that, we are not liable for:
- The outcome of any match, dispute or wager decided by reference to a Scorby score.
- Loss of data that you did not back up, where we hold no copy.
- Loss of profit, loss of opportunity, or any indirect or consequential loss.
- Failures caused by your device, your network, or services operated by Apple or Google.
Where we are liable, and to the extent the law allows a limit, our total liability arising out of or in connection with these terms is limited to the greater of the amount you paid us for Scorby in the twelve months before the claim, or €50.
These terms are offered to you as a consumer. If you use Scorby in the course of a business, the “as is” provision above applies in full and our liability to you is limited to the amount you paid in the preceding twelve months.
Sports bodies
Scorby is not affiliated with, endorsed by or connected to the International Tennis Federation, the International Padel Federation, the Badminton World Federation, or any national association or tournament organiser. References to their rules are descriptive: they identify the rules the app implements, and nothing more.
Apple and Google
This agreement is between you and us, not with Apple or Google, and we alone are responsible for Scorby and its content. Whichever store you installed from, that store did not write these terms and does not provide the app.
Because the App Store requires it
- Apple has no obligation to provide maintenance or support for Scorby.
- If Scorby fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation whatsoever.
- We, not Apple, are responsible for addressing any claim relating to Scorby, including product liability, any failure to conform to legal requirements, and claims under consumer protection or similar legislation.
- We, not Apple, are responsible for investigating and defending any third-party claim that Scorby infringes that party's intellectual property rights.
- You confirm you are not located in a country subject to a US Government embargo or designated as “terrorist supporting”, and are not on any US Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and, upon your acceptance, have the right to enforce them against you.
On Google Play
If you installed Scorby from Google Play, your purchase is also governed by the Google Play Terms of Service, and:
- Google has no obligation to provide maintenance or support for Scorby. Support comes from us — see Support.
- Google is the seller of record for subscriptions bought on Android, and refunds are handled under Google Play's refund policy rather than by us.
- We, not Google, are responsible for Scorby, for any claim relating to it, and for any third-party claim that it infringes intellectual property rights.
- Nothing in these terms limits any right you have under the Google Play Terms of Service or under consumer law.
Where a store's own rules conflict with these terms, that store's rules win for purchases made there. We would rather say so than leave you to discover it.
Ending this agreement
You may end this agreement at any time by deleting the app and, if you have one, your account. Cancelling a subscription is separate and is done through Apple.
We may suspend or end your access if you seriously or repeatedly breach these terms — in particular section 10 — or if we are required to by law. Where it is reasonable to do so we will tell you first and give you the chance to put it right. If we end your access, you may still request a refund from Apple for any unused paid period, and your statutory rights are unaffected.
We may also stop offering Scorby, or any part of it. If we withdraw a paid feature you are subscribed to, we will give you reasonable notice and you may cancel; you will not be charged for a period you cannot use.
Changes
We may update these terms — for example when the app gains a feature, or when the law changes. The version and date at the top of this page always show the current one. If a change materially affects your rights or obligations, we will give you reasonable notice in the app before it takes effect. Continuing to use Scorby after that means you accept the new terms; if you do not, you may stop using the app and cancel any subscription.
Governing law
These terms are governed by the law of the Republic of Cyprus, and the courts of Cyprus have jurisdiction.
If you are a consumer resident in the EU, this does not deprive you of the protection of the mandatory consumer law of your own country, and you may bring proceedings in the courts of the member state where you live.
If any provision of these terms is found unenforceable, the rest continues to apply.
